Who would have guessed last winter that Governor Hickenlooper's own forces would be the first ones to ignore the gun laws signed by their boss.
Hickenlooper's new laws require that every time a gun is transferred for more than 72 hours, a state background check must be conducted by an FFL dealer. When my staff inquired how law enforcement agencies were supposed to comply with that provision as they return firearms to lawful owners, the CBI representative told them law enforcement agencies were not supposed to use the system mandated by Colorado's new laws, but instead they were to conduct their own, limited (non-compliant) background check of the recipient. This is in direct conflict with Governor Hickenlooper's own law.
Additionally, the firearms transfer law gives no exceptions for the issuance of firearms to peace officers or the transfer between them. By Governor Hickenlooper's new law, they MUST go through a full FFL background check prior to issuing them a firearm. The same goes for returning every firearm to the police armory if it's been out for more than 72 hours. HOWEVER, when this matter was brought up to CBI, they advised that law enforcement officers were exempted. I had my staff challenge that assertion and they further advised that this was per the Attorney General's Office. We asked for written documentation and they clarified that the question was asked of the AG's Office, but they are actually awaiting an answer.
I've consulted with our local District Attorney who affirmed that Hickenlooper's law has no such statutory exemption.
Proponents of the new gun control laws stated that the Attorney General's Office would provide legal guidance and would "fill in the blanks" in the laws on matters like "continuous possession" of a magazine or "designed to be readily converted to hold more than 15 rounds." I've spoken with career prosecutors and legal experts on this issue. None of them support the notion that the State Attorney General can fill in the blanks on bad legislation. They can provide guidance to state employees, but they have no authority to rewrite faulty laws.
If Hickenlooper's forces don't understand the law and they encourage violation of the law based on their faulty interpretation, how can the average law abiding citizen be expected to comply with these draconian laws?
Over the coming days, more and more examples will arise of how Hickenlooper's gun laws criminalize average, law abiding citizens, all while doing absolutely nothing to protect them from dangerous criminals.
All this goes into effect while Nathan Dunlap gets a pass from the governor on the order of execution lawfully passed down by a jury for the murder of four innocent people 20 years ago. Shameful!
