Yuma County Sheriff - Colorado
I’ve answered lots of emails and phone calls this past week about my position as the Yuma County Sheriff on the recent gun control laws that Governor Hickenlooper signed into law. There have been a few Colorado Sheriffs who have jumped out in front of the issue and made their positions very public being on several state and nationally television and radio programs. The majority of Sheriffs in Co...lorado hold the same positions.
Before I share my own position, let’s be clear about what “these law’s” are. There have been a few dozen submitted for debate this legislative session, but there are only three that the Gov. signed last week. Those three are; Magazine capacity limits, Universal background checks, and mandatory fees for those required background checks.
Sheriffs have been put in an uncomfortable spot. We swore in our oaths of office to defend the constitution of the United States, and to uphold the laws of the State of Colorado. I believe these gun control laws create a conflict between the law and the constitution. In these cases we have to make a choice as to which carries the heavier weight. I choose, as most Sheriffs do, to give preference to the Constitution that says our ability to be armed as a militia “shall not be infringed.”
I am not suggesting that it is the Sheriffs job to determine constitutionality of laws. That is the job of the judicial branch of our government, and the Sheriff is no doubt part of the executive branch. However, it takes a conflict such as this for the judicial branch to get involved in the process and make a determination. In the meantime, Sheriffs who chose to recognize the conflict and err on the side of the constitution are practicing the checks and balances that are designed to exist in our government between all three branches.
Many Sheriffs, me included, and other groups are now actively moving toward a legal challenge of the constitutionality of these new gun control measures, in order to involve the judicial branch of government, and ultimately get the constitutionality conflict appropriately determined.
The most common question posed last week was, “Come July 1st, will you enforce the new gun control laws?”
No, I won’t be enforcing them. I do believe as I’ve already stated that these laws are in conflict with the constitution, but the more practical reason, is that they are not enforceable. It is not practical to think that law enforcement will be able to provide a prosecutable case to the DA’s office for violations to either of these laws. With the exceptions to the magazine capacity limits that exist to already possess standard capacity magazines, and the 4th amendment protections that will easily keep private gun transactions private, it is understandable why these measures have been labeled as “feel good” laws that in reality don’t increase public safety at all. I concern myself with the security of my community by pursuing measures that will actually increase public safety.
From the beginning of this debate, the Sheriffs of this state have taken a position that violence of any kind, gun or otherwise, is a behavior issue, not a gun issue, or any other specific weapon for that matter. People make poor decisions to cause violence. The tool that they use is a peripheral issue. We have long contended that addressing the complicated issue of mental health in our communities will result in an increase in public safety. There are many different ways to tackle the mental health problem, and we are all better off to push funds and effort to all of the ways to address those decision making problems in our society before we concern ourselves with the tools of violence they may use.
As a practical example, Larimer County Sheriff, Justin Smith suggested to the legislators pushing these gun control measures, with the unanimous support of our state Sheriff Association, to create a statewide database that lists those individuals that are not allowed to possess firearms because of current laws that they’ve broken. That alternative, that actually would assist law enforcement in increasing public safety, fell on deaf ears during these debates.
The take home message that I want my constituents to remember as they are discouraged by these gun control measures, is that I and my fellow elected Sheriffs across the state are well aware that our responsibility is not just to enforce the laws, but to stand up and protect the Liberties that every American is afforded by our founding and ultimate ruling documents, our constitution. This fight is certainly not over.
